A ten-year-old California boy who was arrested after allegedly fatally capturing one other boy with a stolen gun he’d present in his father’s automobile won’t be charged, the Sacramento District Lawyer’s Workplace informed CNN in a press release Thursday.

His father, Arkete Davis, 53, appeared in court docket and was charged Wednesday with legal storage of a firearm, two counts of kid endangerment and felon in possession of a firearm, amongst different fees, in keeping with the DA’s workplace.

“Primarily based on the details at the moment recognized, the only legal legal responsibility and accountability for the kid’s loss of life (lies) completely with this Defendant,” the DA’s workplace said.

Authorities stated Davis was legally prohibited from possessing or proudly owning a gun, and the recovered firearm had been reported stolen in 2017, CNN beforehand reported.

Davis’ son was being held within the Sacramento County Youth Detention Facility. His grandmother informed CNN affiliate KCRA he was launched from custody and is together with his mom in Sacramento.
